The following document contains the Terms of Service for the www.hassleoff.com website, the HassleOFF app and the associated services. Feel free to take a look at our Privacy Policy, which describes our practices in regards to handling any personal information that you may provide to us.
Before using any of HassleOFF’s services, you are required to read, understand and agree to these Terms of Service. You may only sign up after completely reading and accepting these terms.

To make it easier for you to get the gist of each paragraph, we provide a short summary after each paragraph which however, is not legally binding.

1. Acceptance of terms

The web pages available at www.hassleoff.com, all linked pages (“Site”), the HassleOFF app (“app”) and the associated services (“Services”) are owned and operated by Tom Lee UG (haftungsbeschränkt) (“Company”) a German private limited liability corporation and its subsidiaries and is accessed by you under the Terms of Service described below (“TOS”).
Please read these TOS carefully before using the Services. You are agreeing to be bound by these Terms of Service by accessing the Site or the app, viewing any content or using any Services available on the Site (as each is defined below) or the app. You also accept these terms by allowing access to the Service via your personal Facebook account. The TOS and our Privacy Policy govern our relationship with you in relation to the Site and the app. If you disagree with any part of the terms, you may not access the Site or use the app.

By signing up via email or Facebook you agree to our Terms of Service for using our website and/or our app. If you don’t agree you may not use HassleOFF.

2. Registration and eligibility

As a condition to use HO’s Services you have to create a user account with HO by providing mandatory registration information: First name, last name, email and a password. The registration information you provide must be accurate, complete, and current at all times. Failure to do so constitutes a breach of the TOS, which may result in termination of your HO account.
You may not use the name of another person or entity or a name that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You are responsible for maintaining the confidentiality of your password and are solely responsible for all activities resulting from the use of your password and conducted through your HO account.
Services are available only to individuals who are either (i) of legal age to purchase alcohol in your country of residence and in the country from which you are using our services, (ii) at least 18 years old, or (iii) at least 12 years old, and who are authorized to access the Services by a parent or legal guardian. If you have authorized a minor to use the Services, Site and/or app, you are responsible for the online conduct of such minor, and the consequences of any misuse of the Services, Site and/or app by the minor. Parents and legal guardians are warned that the Services, Site and/or app may display photographs and images containing nudity and violence that may be offensive to some users.
The Services, Site and/or app are for use by individuals who are planning and/or participating in private events. If you do not qualify for registration you are not permitted to open an account or use the Services provided by HO.

By signing up and using HassleOFF for your private events you need to be of legal drinking age or have the consent from a legal guardian to do so, as there is a fair chance that you will see advertisement for alcohol or gambling. You also are only to use your real name and valid profile information when signing up.

3. Termination

HO may terminate or suspend this license at any time, with or without cause or notice to you. Upon termination, you continue to be bound by Sections 1-2 and 4-15 of these Terms.
You may delete your HO account upon your own discretion at any time via the Site. HO will confirm the deletion by sending an email containing information about the data, which will be deleted from the system. HO reserves the right to keep a copy of this final email as well as the servers logs regarding the transfer status of this email.

HassleOFF may suspend or delete your account if you don’t behave appropriately. You need to do a lot of shit for us blocking you though. On the other hand, you may delete your HassleOFF account at any time as well, even though we hope this will never happen. We’ll send you an email containing a list of data we have deleted. It’s basically everything (except the final email sent to you) as we are not interested in any of your data.

4. Description of service

The service, the Site and the app allow you to set up and edit private events. You may choose a title, activities, date and time, and a location for the event. Additionally, you may add items to the event that will be needed. The final step in event creation is inviting guests. You may choose as many guests as you like from your built-in address book on your mobile device when using the app, your Facebook friends and generally from the list of people you have had shared past events with. On the web app you may also enter email addresses of your friends to invite them as well.
Other users can also create private events and choose to invite you. Upon receiving such an invitation you may accept the invitation and choose one or more of the available options for the event. In case the person that created the event included items to bring to the event, you may also assign yourself to bring one or multiple items to the event.
Your access to and use of the Services may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair of the Services or any other reason within or outside the control of HO. HO reserves the right to suspend or discontinue the availability of the Services and/or remove any content at any time at its sole discretion and without prior notice. HO may also impose limits on certain features and Services or restrict your access to parts of or all of the Site, the app and the Services without notice or liability.

You can create events and invite your friends from your address book, Facebook friends (given you connected or signed up with your Facebook account). By accepting our terms of services you allow HO to use Facebook as an invitation channel to let your friends know you invited them to a particular event. Note: We do not copy your address book to our servers, as we are not interested in the data of your contacts. Each time you select a name of from your address book we only take this data and see if this contact details are associated with another account. When friends invite you, you will either receive the invitation via email or in your Facebook messages. Things can go wrong sometimes and our services might be interrupted or completely go offline.

5. Content and conduct

Please behave responsibly when using our Services, Site and app. You agree only to invite people to an event that you actually know. You are not allowed to use the Services, the Site and/or the app for any commercial purposes whatsoever. If you do HO is entitled to terminate your account and/or the events created by that account at any time.
You agree to not use the Services, Site and/or app to upload, post, email, transmit or otherwise make available:

Content that is libelous, defamatory, bigoted, fraudulent or deceptive;

Content that is illegal or unlawful, that would otherwise create liability;

Content that may infringe or violate any patent, trademark, trade secret, copyright, right of privacy, right of publicity or other intellectual or other right of any party;

Mass or repeated promotions, political campaigning or commercial messages directed at users who are not connected to you (SPAM);

private information of any third party (e.g., addresses, phone numbers, email addresses, Social Security numbers and credit card numbers); and

Viruses, corrupted data or other harmful, disruptive or destructive files or code.

Furthermore, you agree that you will not do any of the following in connection with the Services, the Site and/or the app:

Use the Services, Site, app in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying them or that could damage, disable, overburden or impair the functioning of the Services, Site, app;

Impersonate or post on behalf of any person or entity or otherwise misrepresent your affiliation with a person or entity;

Collect any personal information about other users, or intimidate, threaten, stalk or otherwise harass other users; and

Circumvent or attempt to circumvent any filtering, security measures, rate limits or other features designed to protect the Services, users of the Services, or third parties.

Just invite people you actually know, as you wouldn’t want an invitation from a stranger would you?

6. Release and indemnity

You hereby expressly and irrevocably release and forever discharge HO, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the Site, the app and our Services.
You hereby agree to indemnify and hold harmless HO, its affiliated and associated companies, and their respective directors, officers, employees, agents, representatives, independent and dependent contractors, licensees, successors and assigns from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys’ fees, resulting from or arising out of (i) a breach of these TOS, (ii) content posted on the Site, (iii) the use of the Services, by you or any person using your account or HO username and password, or (iv) any violation of any rights of a third party.

HassleOFF is not responsible if any damages might occur or if something goes wrong with our service, website, app or anything that might go wrong at the events you plan with it.

7. Trademarks and copyrights

HassleOFF, www.hassleoff.com and other HO graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of HO. HO’s trademarks and trade dress may not be used in connection with any product or service without the prior written consent of HO.
All texts and content available on our Site belongs to HO and is copyright protected. You shall not copy, re-use, duplicate or use it without prior written consent of HO.

You may not use our designs, copyrighted materials and trademarks without our explicit consent.
If you are a journalist, you may use our logo and content in fair use but only if you’re nice

8. Third party sites and services

Our Products may contain links to third-party websites, partners, advertisers, services, special offers, or other events or activities that are not owned or controlled by HO. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from HO, you do so at your own risk and you agree that HO will have no liability arising from your use of or access to any third-party website, service, or content.

HassleOFF or any user may post links to 3rd party websites. We are neither responsible for their content nor can we guarantee that those websites are harmless to you or your device.

9. Governing law and jurisdiction
Our services are controlled from Germany. These TOS shall be governed by the laws of the State of Hamburg, Germany, without respect to its conflict of laws principles. We each agree to submit to the personal jurisdiction of a state court located in Hamburg, Germany for any legal actions.

If you feel like you want to sue us, you have to do it in the beautiful city of Hamburg, Germany. But before you do, please give us a call and let us know what your problem is before we go head to head.

10. Limitation of liability

The web pages available at hassleoff.com and all linked pages (“Site”), are owned and operated by Tom Lee UG (haftungsbeschränkt) (“HO”) a German private limited liability corporation and its subsidiaries and is accessed by you under the Terms of Service described below (“TOS”).
Please read these TOS carefully before using the Services. You are agreeing to be bound by these Terms of Service by accessing the Site or the app, viewing any content or using any Services available on the Site (as each is defined below) or the app. The TOS and our Privacy Policy govern our relationship with you in relation to the Site and the app. If you disagree with any part of the terms, you may not access the Site or use the app.

By using our website and/or our app you agree to our Terms of Service.

11. Responsibility

HO is not involved either in the execution or proper hosting of any events. The sole responsibility lies with the users that joined the event. HO provides a service that eases the communication between friends who know each other in order to get together to an event. HO is not responsible for any damages that might occur at any event that was facilitated through HO’s services.

We are not hosting your event, we are just providing you an option to do so and using a lot less effort. If anything happens at the event, please don’t try to make us responsible for it, as we are not.

12. Copyright complaints

HO respects the intellectual property rights of others. It is our policy to respond promptly any claim that content posted on the Site infringes the copyright or other intellectual property infringement (“Infringement”) of any person. HO will use reasonable efforts to investigate notices of alleged infringement and will take appropriate action under applicable intellectual property law and these TOS where it believes an Infringement has taken place, including removing or disabling access to the content claimed to be infringing and/or terminating accounts and access to the Site, the app and the Services.
To notify HO of a possible Infringement you must submit your notice in writing to the attention of “Copyright Infringement” care of support@hassleoff.com and include in your notice a detailed description of the alleged Infringement sufficient to enable HO to make a reasonable determination. Please note that you may be held accountable for damages (including costs and attorneys’ fees) for misrepresenting that any content is infringing your copyright.
If we remove or disable access to content in response to a notice of Infringement, we will make reasonable attempts to contact the user who posted the affected content. If you feel that your content is not infringing, you may provide HO with a counter notice in writing to the attention of “Copyright Infringement Counter Notification” at support@hassleoff.com. You must include in your counter notice sufficient information to enable HO to make a reasonable determination. Please note that you may be held accountable for damages (including costs and attorneys’ fees) if you materially misrepresent that your content is not infringing the copyrights of others. If you are uncertain whether an activity constitutes an Infringement, we recommended seeking advice of an attorney.

If you think HassleOFF or one of our beloved users has violated your copyrights please send us an email to support@hassleoff.com with the subject “Copyright Infringement”.

13. Change of terms of service

HO reserves the right, at its sole discretion, to modify or replace the TOS at any time. If the alterations constitute a material change to the TOS, HO will notify you by email and by updating the TOS and on the Site. What constitutes a material change will be determined at HO’s sole discretion. You shall be responsible for reviewing and becoming familiar with any such modifications. Using any service or viewing any content following notification of a material change to the terms shall constitute your acceptance of the TOS as modified.

You will be notified if we change these Terms of Service.

14. Security

We deeply care about the security of our users. We are constantly improving protection and security of your content and account but HO cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately if you detect any compromise or unauthorized use of your account.

Security and privacy is more than important to us. Please let us know if you believe you found a breach and we will do anything to fix it ASAP.

15. Your feedback, photos and suggestions

We value our users’ opinions and we are always interested to learn from you how we can make HassleOFF even better. In case you submit suggestions, ideas, photos or feedback, you do agree that HO is free to use them without any restriction or compensation to you. By accepting your submission, HO does not waive any rights to use similar or related feedback previously known to HO, or developed by its employees, or obtained from sources other than you.

We love to hear from you to find out to get better. However, we are free to use any of your feedback, photos and suggestions without any restriction or obligation to compensate you.
